Shinde camp opposes Uddhav Sena’s plea to hold Dussehra rally in Shivaji Park

Shinde camp leader and Maharashtra MLA Sada Sarvankar has filed an intervention application.

In the plea filed by Uddhav Thackeray-led Shiv Sena wanting to hold a Dussehra rally at Shivaji Park in Mumbai’s Dadar area on October 5. Sarvankar’s plea filed in the Bombay High Court prayed that the court should not hear the plea filed by the Uddhav-led Shiv Sena.

It prayed that the court should stay the hearing on the petition filed by Uddhav Sena till the Election Commission of India and the Supreme Court hears their pending pleas regarding party symbols and authenticity and finally decides on the dispute.

Sarvankar said if the high court passed any order on the issue, then it would cause an impediment to the dispute going on about who represents the real “Shiv Sena”. The plea alleges that there are some facts that have been suppressed in the petition filed by the Thackeray-led faction.

Sarvankar, who is the MLA from the Dadar area of the city, said in the plea that Shinde is the “Mukyaneta of Shiv Sena”. He claimed that the petition filed by Uddhav Thackeray’s Shiv Sena is misleading and misrepresentation as they do not belong to the real Shiv Sena political party.

Sarvankar pointed out that there is a dispute in the party itself. “As of date, there exists a dispute about who represents the real Shiv Sena and the issue is pending before the Election Commission of India and also the Supreme Court,” the application said.

The application filed by Sarvankar alleged that under the garb of the present petition, the Uddhav Sena was trying to lay claim on Shiv Sena, it added. Sarvankar added that on August 30 he too had filed an application to the Mumbai civic body seeking permission to hold the Shiv Sena’s annual Dussehra rally at Shivaji Park.

The plea added that the majority support from Shiv Sena is for Eknath Shinde and Uddhav Thackeray has no support within the party. Sarvankar said it was he who used to file applications on behalf of the party earlier for holding the rally at Shivaji Park.

“In the past, this applicant (Sarvankar) was the one who used to file an application to the BMC seeking permission to hold the rally at Shivaji Park,” the application said.

The rally is to be held on October 5 and the plea filed by ‘Shiv Sena, a registered political party’ and its secretary Anil Desai has stated that in 1966 when Shiv Sena was formed as a political party even at that time, a Dussehra rally was held.

Sarvankar’s application is likely to be mentioned before a division bench of Justices RD Dhanuka and Kamal Khata on Thursday which is scheduled to hear the petition filed by Thackeray’s Shiv Sena.
